Lucinda Love Estate Settlement

IN THE PROBATE COURT OF SUMNER COUNTY, KANSAS.
In the matter of the Estate of LUCINDA LOVE, Deceased. No. 8254
JOURNAL ENTRY ON FINAL SETTLEMENT

Now on this 19th day of February, 1941, the hour of 10:00 o'clock A.M., having arrived, this matter comes on for hearing on the petition of E.M. Carr, administrator of the estate of Lucinda Love, late of Sumner County, Kansas, deceased; the administrator appears in person and with his attorneys, Taggart and Taggart, and no other person or persons interested in said estate make any appearance. The court finds due notice of this hearing has been given and published as required by law and the order of this court, and that proof thereof has been duly filed with the court; and said notice and proof are examined and approved by the court and ordered to be made a part of the files and records in said estate.

The court after hearing the evidence and being fully advised in the premises, finds the decedent died intestate on the 23rd day of April, 1939; that at the time of her death she was a resident of and had her post office address at Wellington, Sumner County, Kansas; that said estate has been fully administered; that all inheritance taxes determined to be due the state of Kansas are paid, and that all estate taxes determined to be due the United States are paid; that the residue of said estate consists of the following described real estate, all of which is situated in Sumner County, Kansas, to-wit:

The East Half (E1/2) of Section Thirty Six (36) and the Southeast Quarter (SE1/4) of Section Twenty-five (25), all in Township Thirty-one (31) South, range Three (3) West, and

The Northeast Quarter (NE1/4) of Section One (1) in Township Thirty-two (32) South, Range Three (3) West, and

Lots Seventeen (17) and Eighteen (18) in Block Ten (10), L.K. Myers Addition to the city of Wellington, Sumner County, Kansas.

Also decedent left personal property, consisting of United States Treasury Bonds, with accrued interest, of the value of about $34,615.67; cash and promissory notes of the value of about $5,879.08; household goods, automobile and 105 lbs of cane seed of the value of about $665.50.

That the said decedent left surviving her as her sole heirs at law, the following named persons, whose names and addresses follow:

Charles Bowles, minors, Great Nephews, all of Louisville, Kentucky.

The court finds that the above named, Elizabeth F. Hoard, is the daughter, and sole surviving heir at law of one, Betty Hoard, who is now deceased, and who was a sister of the decedent, Lucinda Love. That the above named, Hattie Hayes, Clarence P. Bowles, Flora Lane, Dimple Raven, Lela Ethel Bowles, and Lessie Norman, are the children and sole surviving heirs at law of John Bowles, now deceased, who was a brother of the said decedent, Lucinda Love; and that Olive Constance White and Ola Creacy are the daughters of one, W. C. Bowles, deceased, who was a brother of the decedent, Lucinda Love, and that said daughters, and [name removed] Bowles, [name removed] Bowles and [name removed] Bowles, minors, are the sole surviving heirs at law of the said W. C. Bowles; and that said minors, are the surviving children and sole heirs at law of Gilford Bowles, deceased, who was a son of the said W. C. Bowles, also deceased.

THE COURT FURTHER FINDS, that said estate is fully probated and that the above described real estate and personal property and all other estate of the decedent, Lucinda Love, within the state of Kansas, subject to any lawful disposition heretofore made, be, and the same should be assigned to and vested in the following named persons in the following proportions or parts:

Delia C. Beard and Elizabeth F. Hoard, each, a one-fourth:

Hattie Hayes, Clarence P. Bowles, Flora Lane, Dimple Raven, Lela Ethel Bowles, and Lessie Norman, each, a one-twenty-fourth, (1/24th):

Olive Constance White and Ola Creacy, each, a one-twelfth, and [name removed] Bowles, [name removed] Bowles, and [name removed] Bowles, minors, each a one-thirty-sixth (1/36th).

IT IS THEREFORE BY THE COURT CONSIDERED, ORDERED, ADJUDGED, AND DECREED, That said estate is fully administered, and that the acts and doings of the administrator in said administration are approved and confirmed, and distribution of the assets are now decreed.

It is further adjudged and decreed by the court that the above described real estate and personal property and all other estate of the decedent within the state of Kansas, subject to any lawful disposition heretofore made, be, and the same is hereby assigned to and vested in the following named persons, who are adjudged t obe the sole heirs at law of the said decedent, Lucinda Love; and that said estate be distributed to and vested in them in the shares and proportions, as follows:

To Delia C. Beard and Elizabeth F. Hoard, each, a one-fourth;

To Hattie Hayes, Clarence P. Bowles, Flora Lane, Dimple Raven, Lela Ethel Bowles, and Lessie Norman, each, a one-twenty-fourth;

To Olive Constance White and Ola Creacy, each, a one-twelfth, and to [name removed] Bowles, [name removed] Bowles, and [name removed] Bowles, each a one-thirty-sixth.

It is further ordered and decreed that upon filing the receipts of the above named heirs at law, showing distribution of said personal estate to them, as above ordered, that the said administrator and his bondsmen be discharged and exonerated from further liability.
