Russel Petree to Elbert Petree

Two years after the heirs of John Petree's estate had sold tracts 838 and 819 to their brother Russel Petree, he in turn sold them to his brother Elbert Twiggs Petree.

This deed was first recorded on January 16, 1888 in Deed Book Y, Page 106. It was then re-recorded on February 22, 1889 in Deed Book Y, Pages 470-471 along with a a statement that Elbert was using it as security on a loan of $375 obtained from H. B. Wofford.

Of the other names listed, H. K. Petree is Henry King Petree, a brother of Russel and Elbert, and J. R. Roach is probably a relative of Elbert's wife, Delphia Elizabeth Roach Petree. Also Lawson H. Petree, a half-brother, is listed as a Notary Public and Ex officio Justice of the Peace in 1889.

State of Georgia, Cherokee County
This Indenture made this the 10th day of January, Eighteen Hundred and Eighty Eight between R. R. Petree of the State of and County aforesaid of the one part and E. T. Petree of the same place of the other part: Witnesseth that the said R. R. Petree for and in consideration of the sum of six hundred Dollars to him in hand paid at and before this sealing & delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and doth by this presents grant bargain sell and convey unto the said E. T. Petree his heirs and assigns One lot of land No. (838) Eight hundred & thirty Eight, One (819) Eight hundred & nineteen containing (80) acres more or less lying and being in 15th District & 2 Section of the County aforesaid. To have and to hold said tract of land to him the said E. T. Petree his heirs and assigns together with all and singular the rights members appurtenances to the same in any manner belonging to his and their own proper use benefit and behalf in fee simple. And the said R. R. Petree for himself his heirs executors administrators the said bargained premises to the said E. T. Petree his heirs & assigns will warrant and forever defend the right and titles thereof against themselves and against the claims of all other persons whomsover. In witness whereof the said R. R. Petree hath hereunto set his hand & affixed his seal the day and year above written.

In person appeared before me L. H. Petree a Notary Public and Ex officio Justice of the Peace in and for said County J. R. Roach who after being sworn says that he was present and saw R. R. Petree sign seal and deliver the witnessed deed for the purposes therein specified and that he saw W. H. Rice and H. K. Petree sign as witnesses and that he also signed the same as a witness.
